Booking, Payment, Cancellation and Refund Policy
Lynda Pianosi, operating as Three Mountain Family Hikes Inc.™ (or a corporate nominee thereof, including its subsidiaries and corporate affiliates) (collectively, “THREE MOUNTAIN FAMILY HIKES INC.”), provides an online service that enables individuals to research, locate, and book guided activities in Western Canada, made available by THREE MOUNTAIN FAMILY HIKES INC.’s third party suppliers through www.ThreeMountainFamilyHikes.ca and THREE MOUNTAIN FAMILY HIKES INC.’s websites, mobile properties and related applications (collectively, the “Website”). The Website is provided to assist customers in gathering information, and searching for and booking reservations, and for no other purposes.
Through the Website, an individual (a “User”) may register an account with THREE MOUNTAIN FAMILY HIKES INC. (a “User Account”) for the purposes of booking the guiding services of a THREE MOUNTAIN FAMILY HIKES INC. registered guide (a “Guide”). A booking reservation made by a User on the Website (a “Booking”) is subject to the terms of this Booking, Cancellation Policy and Refund Policy (this “Policy”). User activity on the Website and User Accounts are governed by the terms of THREE MOUNTAIN FAMILY HIKES INC.’s Terms and Conditions (the “T&C”), which is incorporated into and forms part of this Policy. The most recent version the T&C may be reviewed by clicking on the “Terms and Conditions” hypertext link located on the Website.
- ACCEPTANCE OF TERMS
By requesting a Booking, User accepts the terms of this Policy. THREE MOUNTAIN FAMILY HIKES INC. reserves the right to update this Policy at any time pursuant to Section 2 herein. The most recent version of this Policy can be reviewed by clicking on the “Booking, Payment, Cancellation & Refund Policy” hypertext link located on the Website.
- CHANGED TERMS
THREE MOUNTAIN FAMILY HIKES INC. shall have the right at any time to change or modify the terms of this Policy, or to impose new conditions, including, but not limited to, adding or amending fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on the Website, or by electronic or conventional mail, or by any other means by which User obtains notice thereof. The request of any Booking by User after such notice shall be deemed to constitute acceptance by User of such changes, modifications or additions.
Through the Website, User may send a request for a Booking by requesting services for the purposes of participating in a guided hiking or cross-country ski activity (herein called the “Activity”) based on the availability of a Guide. Once a User’s request is accepted, the Booking is finalized and User’s payment will immediately be processed pursuant to Section 6 herein.
- GUIDES AND FORMS
Guides are independent contractors and not agents or affiliates of THREE MOUNTAIN FAMILY HIKES INC. User’s use of the services provided by a Guide is at User’s sole risk. Users are responsible for working directly with Guides on scheduling, meeting time / place, and Activity specifics. THREE MOUNTAIN FAMILY HIKES INC. makes no representations or warranties of any kind regarding Guides and their services. Specifically, THREE MOUNTAIN FAMILY HIKES INC. does not warrant the quality, safety, or level of difficulty of Activities.
Before the Activity takes place, all participants in the Activity must execute and deliver a waiver and a medical information statement in the forms prescribed by THREE MOUNTAIN FAMILY HIKES INC. from time to time (the “Forms”). Where a User or participant in an Activity is a minor, the Forms must be signed by a parent or legal guardian thereof. Current versions of the Forms shall be made available for download on the Website.
Prices listed on the Website are per person, unless otherwise specified.
Price quotations are subject to change without notice, until a Booking has been confirmed.
Prices do not include tips/gratuities to Guides.
When a User confirms a Booking through the Website, THREE MOUNTAIN FAMILY HIKES INC. collects User’s payment information and will processes payment for the full cost of the Activity that is the subject of the Booking. Full payment is required to confirm a Booking.
- CANCELLATIONS & AMENDING A BOOKING
If THREE MOUNTAIN FAMILY HIKES INC. Cancels:
THREE MOUNTAIN FAMILY HIKES INC. reserves the right to cancel or re-schedule any outing at any time without notice. Weather, safety hazards, wildlife activity, fire alerts, fire bans, park and trail closures, low registrations or other circumstances may occur: however, we will attempt to give as much advance notice as possible to our customers.
If a trip is cancelled by THREE MOUNTAIN FAMILY HIKES INC. due to reasons stated above or for an unforeseen incident, a full refund will apply. Additionally, some Activities may have their locations changed without notice due to the weather, safety hazards, wildlife activity, fire alerts, fire bans, park and trail closures. Participants will be informed of a change in location at the very latest at the meeting place before we proceed onto the trail or participating in the Activity. If the Activity needs to be re-scheduled, THREE MOUNTAIN FAMILY HIKES INC. will make best commercial efforts to book registrants to another program on another date. If we are unable to reschedule, a full refund will apply.
If a User Needs To Cancel
Please email Lynda@threemountainfamilyhikes.ca to advise of your cancellation, and provide the date and Activity that you were attending.
The following cancellation policies apply:
- Full refund Seven days prior to the date of the Activity(ies)
- Full refund or option to reschedule if THREE MOUNTAIN FAMILY HIKES INC. need to cancel for circumstances beyond our control, up to and including the day of the trip.
- 50% refund if cancelled before 48 hours (2 days) before the day of the Activity(ies)
- No Refund for a No Call/No Show on the date of the Activity(ies).
Exceptions – I completely understand that some things are beyond our control such as unexpected road closures, car problems and sudden changes in mountain weather. In addition, as a parent, I have said goodnight to a healthy child, only to be woken up at 3:00 a.m. by a sick child. Please email directly so that we can discuss these types of situations so that we can determine a mutually agreeable solution.
Right To Decline Any Participant
THREE MOUNTAIN FAMILY HIKES INC. reserves the right to decline any participant, at any time, as a participant in any Activity. An example, but not limited to, is inappropriate gear for the activity i.e. open toe sandals for a hiking program.
As a participant in an Activity, it is essential that a User give full disclosure on the medical information form so that THREE MOUNTAIN FAMILY HIKES INC. can be appropriately prepared for an emergency, should one occur. Failing to disclose all medical/ health information will result in the cancellation of the Booking and a refund will not be provided.
No Pet Policy, Other than Service Animals
I love dogs, I have one, but she needs to stay at home, as will your dog. My insurance does not cover hiking with dogs. Certified service dogs/other animals are an exception. If you do arrive with a family pet, THREE MOUNTAIN FAMILY HIKES INC. will automatically cancel your participation in the Activity, and no refund will be provided. Thank you for your understanding
Non-Medicinal Drug, Alcohol and Smoking Policy
THREE MOUNTAIN FAMILY HIKES INC. will not tolerate the use of non-medicinal drugs (including cannabis), alcohol or smoking during an Activity, and reserves the right to ban the participant(s), with no refund provided. In addition, we reserve the right to contact the appropriate authorities to deal with situations involving illegal substance abuse.
